论我国民事救助义务的确立

民事救助义务是民事作为义务的一种,大陆法系国家有明确且一般性的民事救助义务立法,英美法系虽然坚持无救助义务规则,却承认了越来越多民事救助义务的例外情形。随着见死不救的案件逐渐引起社会的关注,我国对民事救助义务的立法成为一种社会需求,但是将道德义务上升为法律义务,还应当借助救助者与被救助者的关系类型以及救助行为的合理性等因素来限制民事救助义务的范围。

On the Establishment of Civil Aid Obligation in Our Country

The civil aid obligation is one of civil act duties.There are clear and general civil aid obligations legislation in the mainland legal system countries.Although there is no aid obligations in common law legal system countries,but more and more exception cases are admited.The cases caused by people’s indifference to do nothing to save others in mortal danger gradually arouse the attention of the whole society.It has become a social request to make civil aid as a legal obligation in our country.But it depends on the relationship type between rescuers and saviors and the rationality of the behavior to limit the scope of the obligations when the moral obligations become legal obligations.
