我国公务员行政处分制度中的问题与对策

摘    要:我国现行公务员行政处分制度的主要内容包括行政处分的基本依据、基本程序、救济制度;主要问题是行政处分依据不合理、程序不公平、救济不完善、相关处理措施不配套;基本对策是创新行政处分理念、加强行政处分法治、综合运用相关手段。

Abstract:The three main contents with the system of now administrative disciplinary measure to civil servants in China are the basic gist of administrative disciplinary measure,its basic proceeding and its relief regulations.There are four main problems on the system.First,its basic gist is not rational.Second,its basic proceeding is not equitable.Third,its relief regulations are not perfect.Finally,its correlative means is not integrated.Three basic countermeasures of perfecting the system are as follows: Innovating administrative disciplinary measure idea,strengthening its rule by law and exercising synthetically the correlative measures.
