国际知识产权管辖权消极冲突的解决

一国对于侵犯外国知识产权的诉讼经常拒绝实施管辖，这往往引发国家主权之间的矛盾以及公权与私权之间的矛盾，作为发展中国家的中国也同样面临这一问题。文章通过对国际知识产权管辖权制度相关内容的分析，提出在解决消极冲突问题上，需要实施协调缔约和制定国际统一规范这两个步骤，以最终达到保护知识产权，维护当事人合法权益的目的。

The Passive Jurisdiction Conflicts on the International Intellectual Property Right

The conflicts on sovereignty and power- right between different countries can also be caused by that one country refuse to accept the suit that inviolate the foreign countries＇intellectual property right. To be a developing country, China also faces with the same problem. The article analyses the jurisdiction system, puts forward two stages to settle the passive conflict to protect intellectual property right and the parties＇legal right to make coordination contract and then to set up an unified international regulation.
