| 摘 要： | "科学证据"并不一定科学,因此审查经科技手段取得的证据应当有明确、科学的标准.标准的确定着重解决证据本身所使用的科学方法和应用证据解决具体问题所使用的科学方法或程序.而制定我国判断证据科学的标准时,应以波普尔"证伪说"为理论基础,吸收DAUBERT具体标准的优点,克服其不足之处.

| Abstract: | Scientific evidence" is not automatically of science .So ,there should be exact ?scientific standards in legal arena to check "scientific evidence".the standards should be focused on the science theory itself and the methods and programe we apply science theory . While making our law standards for "scientific evidence".we should base on Karl Raimund Popper's theory . absorb the advantage of the DUABERT standard and abandon its disadvantage. |
