试论犯罪行为机制

犯罪行为机制是反映犯罪行为诸要素及其与之紧密相关、不可或缺的其他要素之间有机联系的整体概念 ,包括促使犯罪行为发生的发生机制、运作机制和抑制机制。发生机制和运作机制是推动犯罪行为发生和运作的机制 ,而抑制机制中的主观抑制因素对犯罪行为起平抑作用 ,客观抑制因素则对犯罪行为起阻碍、遏制作用 ,但无论主观因素还是客观因素 ,都是犯罪行为选择的筹码和根据。弄清犯罪行为机制对预防和治理犯罪既具有重大的理论意义 ,又具有重大的实践意义。

On Criminal Offense Mechanism

Criminal offense mechanism is the concept of viewing the situation as a whole reflecting the organic relation between the elements of criminal offenses and other ones closely related and indispensable,including occurring mechanism of causing criminal offenses to happen, carrying out offenses and controlling. Occurring mechanism and operating mechanism are the ones to cause criminal offenses to happen,while the subjective elements of controlling mechanism can stop and restrain criminal offense. But whether subjective element or objective element it is ,they are the counter and foundation chosen in criminal offenses. It is of great importance not only in theory but also in practice to make sure criminal offense in preventing and administering crimes.
