| 摘 要： | 商法基本理论不仅包括商法总论,还应包括商法分论的基础部分。2007年商法学发展表明,商法基本理论研究的新成果是商法学发展的重要标志,结合商事实践和商事审判运用多元的方法论认识商法是拓宽商法学研究领域的必然趋势,在商法总论和分论的结合上把握商法是商法发展走向科学的保证。

| Abstract: | Business law theory includes not only general doctrines but also basic parts of individual doctrines.the development of business law research in last year shows that new fruits in general doctrines research are important indication of development of business law,making use of multi-methods in combination with business practices and judicial decisions to research is a necessary trend in order to broaden the research area,and putting these two parts together is the safeguard for business law developing into a science. |
