| 摘 要： | 任何一项法律制度均有其基础性价值作为赖以存在和发展的根源。我们只有挖掘陪审制度的基础性价值,才能抵制住汹涌而至的对陪审制度的批评,才能找到陪审制度改革和完善的理论基础。使裁判获得正当性,增强社会公众对司法的信任是陪审制度的基础性价值,也是我国进行陪审制度改革和完善的理论基础。此项基础性价值对我国陪审制度的改革和完善具有原则性的指导意义。

The basicai value of jury system has guiding signifance in improvement and perfection of july system. |
