民间法的秩序还是民间的法秩序？

当下的民间法研究出现了套路化的倾向，因此有必要对此问题进行研究。文章认为，一种有别于国家法所希冀构建的秩序的存在是进行研究的基础，但是当前的民间法研究并没有重视这一问题；反而是走进了以发现规则的误区之中，从而导致了研究的套路化的问题的出现，因此有必要走出这种误区，形成一种开放的而非封闭的、发展的而非静止的思路。

Order of civil law or law oeder of civil？

There is a tendency of routines in present study of civil law, so it is necessary to discuss this issue. This paper considers that there is a civil order as the basis of our study, but some researchers do not pay attention to this basis. Some resesrchers go into the misunderstanding of finding rules, and lead to the problem of tendency of routines of ou study, thus we should walk away fron this minunderstanding and constract a open rather than closed,developing rather than static idear.
