| 摘 要： | 破产重整制度作为现代破产法制度体系的重要组成部分，是一种用于拯救陷于无力清偿状态的债务人并促使其复兴的破产预防制度。在我国对重整制度的研究讨论已经多年，而重整制度真正纳入法律是在2006年8月27日颁布的《中华人民共和国企业破产法》中第一次体现。笔者因《企业破产法》的出台对重整制度更加关注，文章从国外立法经验与国内立法和国情出发阐述了重整制度的相关法律问题。

| Abstract: | Reorganization system, as the important component of modern bankrupt legal system, is the bankrupt prevention system that is to save the debtor who is unable to discharge and impel to rejuvenate. In our country, the reorganization system has been discussed in academic circles for a long time. However, its first being regulated in bankruptcy law of PRC was on August 27, 2006. Since this new bankruptcy law has been promulgated, the author pays more attention to reorganization system. In this thesis, the author expounds some related aspects of reorganization from the points of legislative experience abroad and domestic legislative situation. |
