论服刑人员的生育权问题

服刑人员的生育权是法律的空白点,一直受到人们的关注。但是,从法不明文规定不违法、刑罚之目的、人权主义思想、婚姻家庭稳定等因素出发考察,服刑人员应当依法享有生育的权利,不能因为曾经犯罪而被随意剥夺。由于服刑人员的人身自由受到限制,生育权的行使面临着现实的掣肘。目前,离监探亲、同居会见、现代辅助生殖技术是实现服刑人员生育权最切实可行的路径。

On Prisoners Reproductive Rights

Prisoners reproductive rights is the gap in China＇s laws, which attracts the popular concern. However, based on investigations from the perspectives of the conception that there is no penalty outside the law, the purpose of the penalty, human rights thought and stability of harmonious family and marriage relationship, the prisoners shall, in accordance with the law, not be deprived of reproductive rights because of having committed crimes. As the prisoners personal freedom is restricted, there is practical constraint preventing exercise of their reproductive rights. The present feasible approach to realize prisoners＂ reproductive rights is by off jail relativevisiting, cohabitation meetin~ and modern assisted reproductive technology.
