对行为请求权的强制执行的思考

在执行方面,理论界和实务部门特别关注的是金钱债权的执行,相比之下,对行为执行的研究甚少.本文从行为请求权的概念界定入手,结合对当下我国在行为请求权执行实践工作的现状分析,以及对域外法治发达国家和地区在此领域的学习和研究,以期能够找到完善我国行为请求权执行的运行机制的方法和途径.

Consideration on Compulsory Enforcement of Right to Request Behavior

In aspect of enforcement,both the theorists and the practical department pay specially attention on the money creditor’s rights enforcement,comparatively,too little research is done on behavior execution.From the concept of the behavior request right,this article give analysis on present situation of right to request special behavior in practical work,as well as the concerned study and research in foreign countries and area outside China,where the government by law developed better,So as to hope to find the operational mechanism and method to consummate the enforcement of behavior request right in our country.
