动物法律地位确置论

动物应当受到保护,人应当给予动物应有的生存条件.然而,人类中心主义的价值观必然是不可超越的,同时,绝对的人类中心主义已经不能适应社会的发展,相对的人类中心主义成为时代的主旋律.动物主体论脱离现实的论调理应受到我们的批判,结合我国国情,以物权法和侵权责任法为基础,动物应当被认定为客体,是人所管领的财产.

Discussion on the Animal Legal Status

The animal should get protection,the human should give the animal the proper survival requirement.However,value of the human center principle is impassable inevitably,simultaneously,the absolute human center principle already could not adapt society’s development,the relative human center principle has become the main melody of the time.The animal main body view is separated from the reality,which should get critique,unifying our national condition and taking the real law and the right infringement responsibility law as the foundation,we should recognize the animal for the object,the property which the human manages and leads.
