行政立法的价值可以决定行政立法的效用、行政立法的利益归属、行政立法的发展方向、行政立法的总量等 ,然而 ,这一根本问题没有有效地反映在《中华人民共和国立法法》中。本文从理论与实践两方面分析了行政立法合理价值的条件 ,并构设了行政立法合理价值的内容 ,如实现宪法原则、补充法律规则、维护法律秩序和便于相对人权益的实现等

On the Value -choice of Administrative Legislation

The value of administrative legislation determines the utility, the ownership of interests, the direction of development and the total quantity of administrative legislation. However, this fundamental problem hasn't been reflected effectively in the Legislative Law of People's Republic of China, which results that administrative legislation in our country has fairly serious shortcomings of value. This article analyzes conditions of reasonable value of administrative legislation from two aspects of theory and practice and designs such contents of reasonable value of administrative legislation as implementation of constitutional principles, supplementation of legal rules, safeguard of legal order and facilitation to realize private parties' rights and interests.
