祖国大陆学者关于“社会法”语词之使用考

祖国大陆学者近十年来在法学研究中,使用的“社会法”语词十分宽泛不统一,这些关于“社会法”语词的使用可以归类为狭义、中义、广义和泛义四个层面。其中部分中义的使用具有“中国特色”。我们今后相关的法学研究中,只需了解、辨别和掌握可以从哪些不同角度和层面上使用“社会法”这一法学术语即可,而不必试图得到一个能被较为普遍地接受的定义,但必须在今后的学术讨论中指明所使用的“社会法”用语的层次。

Exploration of the Usages of"Social Law" by Mainland Academics of China

The usages of “Social Law”by mainland academics of China,in the passed ten years,are random and inconsistent.They can be divided into four levels:the narrow meaning,the medium meaning,the wide meaning and the extensive meaning,and some of those medium meaning level“Social Law”usages have Chinese Characteristic.To understand which usage means the exact meaning level of Social Law is enough for relevant studies henceforward.There is not a universally accepted conception of Social Law,however,to point out of the usage level is the primary request in the academic argument.
