| 摘 要： | 新《合同法》第一次明确规定了我国的表见代理制度,本文剖析了两大法系表见代理制度与我国表见代理制度的异同,结合法学界不同观点对表见代理的构成要件进行分析和论证,并对实践中应注意的问题进行探讨,以期完善我国的民事代理制度。

| Abstract: | It was the first time that in the Law of Contract of People's Republic of China, 1999, the institution of apparent representation was explicitly enacted. Now this essay focuses on the analysis among the institutions of apparent representation in the two genealogies of law and in China. According to the combination of the views in Jurisprudential circle, the key elements of the institution of apparent representation are dissected and argument Ted. The author also probes into the relevant problems which merits attention in practice and looks forward to perfecting the current institution of civil agency. |
