法庭论辩中的诡辩与驳斥

法庭论辩是一项神圣的法律诉讼活动 ,其目的在于运用法庭论辩这一武器 ,捍卫法律尊严 ,切实维护诉讼者的合法权益 ,协助和促使审判机关对案件作出公正的裁判。然而 ,庭审中有的诉讼论辩者利用诡辩迷惑对方 ,进而影响案件的裁判。偷换论题、循环论证、强词夺理、以人为据、诉诸感情、机械类比、复杂问语等都是庭辩中经常使用的诡辩方法。要彻底驳斥诡辩 ,只限于逻辑方面是不充分的 ,还必须运用马克思主义认识问题的方法 ,同时又要具有深厚的法学功底。

The Refutation And Sophistry During Court Debate

As the means and ends of defending the law dignity;upholding the legal rights of litigation;helping and urging the judicial organs make a fair adjudication to the case,the court debate is a sacred law litigation activity. However,some litigation in court debate confuses the other party by taking advantage sophistry in hearing procedure,and then affects the adjudication of the case. The wiles often be used in court debate include: perpetrate fraud,circular argument,argue irrationally,take evidence according to special person,appeal to the affection,mechanical ratio,complicacy asks etc. The common logic means are deficient to refute sophistry thoroughly,besides,the litigation in court debate should use of the Marxism method of understanding problem,at the same time,must have the deep bottom of jurisprudence.
