| 摘 要： | 证人作证问题是民事诉讼的基本问题,也是民事诉讼言辞中心主义的关键所在.关于证人拒绝作证其实是个价值衡量的问题,在涉及案件事实与其他价值冲突时是否一味追求真实,如何处理也值得探讨.证人拒绝作证不是因为其本身有什么特权,而是因为其负有对相关人的保密义务(如医生对病人负有保密义务),所以准确地说应该叫证人拒绝作证的义务.

| Abstract: | Witness testimony is the key of words-centre in civil actions.This problem refers to several values,and we should know how to deal with it when lawsuit truth and other values conflict.Nearly all the experts consider that people have the privilege of refusing to be witness.The article does not accept this opinion.The author thinks that someone refuse to be witness is not for his privilege but for others.So I call it the obligation of refusing to be witness. |
