环境侵权的层次性

祖国大陆的环境法学者开始从加害人的民事责任或国家对加害人的民事制裁的角度对环境侵权进行研究,主要着眼点多为无过失责任原则、因果关系推定、举证责任转移、责任方式、救济制度等。但是,对于环境侵权的类型这一前提性问题的探讨,则不够深入全面。本文综合民法、环境法、行政法和国际法的内容,尝试提出“环境侵权的层次性”这一概念。

The Hierarchical Nature of Environment Infringement

The scholars of environment law in mainland China start to study environmental tort transferring from the angle of the civil liability of the offender or the country to the civil restriction. Their chief concern centers on the principle of the liability for negligence, presumption of cause and effect, transfer of burden of proof, way of liability and remedial institutions etc. Nevertheless, they do not have a deep and comprehensive study of the prerequisite problem of the types of the environmental tort. The thesis, in combination with the civil law, environmental law, administrative law and international law, ties to create the concept "the hierarchical nature of the environmental infringement."
