| 摘 要： | 举证突袭不可全盘否认，有的时候是必须采取的诉讼手段。我国民事诉讼宜采取证据随时提出主义为主、适时提出主义为辅的证据制度，庭前交换证据应当慎重进行。

| Abstract: | The phenomenon of unexpected presentation of evidence is not unnecessarily dispensable but occasionally a dispens-able means during legal action. It is believed appopriate in China to adopt the proposition that evidence presentation should be me occasional than timely. The rule of exchange of evidence preceding a court decision should be precautiously handled. |
