宪法语境下人格尊严之再认识

人格尊严是指人作为人应具有的最起码的资格,是人之为人所必须享有的地位、待遇和应受的尊重.学术界对于人格尊严概念的界定和使用存在混乱,为学术研究带来障碍.民法领域中的人格尊严属于一般人格权的核心内容,主要针对具体人格权而言.这种把人格尊严只当成人格权的一项权能的做法,从根本上抹杀了人格尊严的实质价值.从宪法学角度分析可以看出,人格尊严具有浓郁的宗教和哲学背景,是宪法的价值核心,是基本权利的基础和保障.
