| 摘 要： | 现阶段我国农村社区建设在制度、市场、组织、文化等维度的利益非和谐现象日趋增多,严重制约着农村社区建设的进行,作为社会的综合现象,从根本上说是现行的制度安排扭曲了利益机制的作用。在法学理论上对利益基本原理进行解构,实现利益机制的反扭曲,建构双重利益模式和谐互促,利益聚合到利益和谐的转变和农民个体利益的实现等良性利益机制,是推进农村社区建设,构建和谐社会的新思路。
