| 摘 要： | 面对一起旅客乘机纠纷,机场动用了警力对待旅客,案中警察权的发动是否合法,是否具有正当性与合理性? 警察应该怎么处置类似情形? 厘清警察采取的强制措施在法律上的属性,旅客的行为该如何定性等问题,确立一定的原则,对警察出警时面对复杂多样的社会情况准确判明该不该介入,该不该采取强制措施会有所帮助。

| Abstract: | In order to settle a conflict between the airport and passengers, the airport resorts to police force. Is it legal to employ police force in this case? Is it rightful and reasonable? How should the police deal with those cases of same circumstances? The classification of police's coercive measures in law, the nature of passengers' acts, and the establishment of a set of principles for the former two parts will be helpful for the following two situations: how to make a correct judgment on whether to interfere in or not, and whether it is necessary to take coercive measures or not when the police force is confronted with a complicated social situation. |
