| 摘 要： | “例”是传统中国法的一个重要组成部分.“例”字起源于“列”字,其起初多用于经学领域,后来渐用于法律领域.唐代以前的立法已不可详考.目前所能见到的保存下来的最为久远的成文法典《唐律疏议》,其“例”字义项众多,但无判例之义.即使与之密切相关的“比”字也没有判例之义.对于中国法律史是否存在判例这一问题,人们所给予的关注需要适度.

| Abstract: | Li is of very importance in traditional Chinese law. The character of Li originated from the character of Lie, and it was used in the study of Coufucian classics, then gradually used in the legal field. We have not been a-ble to give a detailed examination to the legislation before Tang Dynasty. The character of Li in Tang Code has many meanings, but it does not have the meaning of prejudication. And even the character of Bi does not have the meaning of prejudication. For the traditional Chinese law whether there is prejudication, people today do not necessarily have an overly complex on prejudication in Chinese legal history. |
