论发展权视野中农地产权保护的法律机制

农地产权制度确立不仅是农民财产权益保障的起点和基石,也是市场经济发展的必然要求,更是统筹城乡发展,促进社会主义新农村建设的关键举措.然而现实中违法征用土地现象严重,农地产权保护中主体虚位、产权虚置,权能残缺,国家对农地发展帮助权也存在缺位,严重损害了农民的主体性发展.建设社会主义新农村,促进农民发展,必须科学设置农地产权制度、完善村民自治、保障农民结社权、强化司法救济,为农地产权保护提供制度、政治、组织乃至司法保障;同时必须规范土地市场,保障土地合法流转.

The System of Protecting Title of Countryside Land

To establish the title system of countryside is not only starting point and foundation,but also in- evitable request of market economy.Meanwhile it is a key measure to promote the development of city and coun- try wholly,and build socialism new countryside.However,in practice,it is serious to make a requisition for land illegally.In protecting title of countryside land,there are some serious problems,for example,the title is nominal,the subject of title is in name only,and power and function of the title is incomplete.In order to build socialism new countryside and promote the development of countryside,we must provide for systematic,politi- cal,organization and judicial protection by establishing the title system of countryside land scientifically,perfec- ting self-governing by villager themselves,safeguarding the right of association of peasants and strengthening judicial remedy.Meanwhile,we should standard the land market and protecting the turnover of land legally.
