论政府的民生尊重义务

恪守民生尊重义务,是政府保障和改善民生的基础。民生尊重义务对应民生对政府的防御权功能,包括不作为的形式尊重和作为方式的实质尊重。在政府保障民生的实践中,因部分民生尊重义务履行不到位,一定会程度上使得民生问题复杂化。政府履行尊重民生义务,应在坚持民生价值取向、消解民生价值与行动逻辑背离的基础上坚持有限政府原则,以不作为方式确保对民生的形式尊重。为方便民众自我实现民生,应积极提供民生信息、确保民生参与、改变民生干预方式,以助力性的作为方式体现对民生的实质尊重。

On the Government’s Obligation to Respect People’s Livelihood

Abiding by the obligation to respect people’s livelihood is the basis for the government to ensure and improve people’s livelihood.The obligation to respect people’s livelihood corresponds to the function of people’s livelihood’s defense right to the government,including formal respect for inaction and substantive respect for action.In the government’s practice of ensuring people’s livelihood,it is easy to complicate people’s livelihood problems because some people’s livelihood respect obligations are not fulfilled in place.To fulfill the obligation of respecting people’s livelihood,the government should adhere to the principle of limited government and ensure formal respect for people’s livelihood by inaction on the basis of adhering to the value orientation of people’s livelihood and eliminating the deviation between people’s livelihood value and action logic.In order to facilitate people’s self realization of people’s livelihood,actively provide people’s livelihood information,ensure people’s livelihood participation,change people’s livelihood intervention methods,and reflect the substantive respect for people’s livelihood in a supportive way.
