On the system of Self-Supplementary Detection and Returning Supplementary Investigation

On the basis of the promulgation of the supervision law and th e revision of the criminal procedure law,the connotation,extension and relevant structure of supplementary investigation have been greatly adjusted.Therefore,it is necessary to re analyze the essential attributes of supplementary investigation and construct the relevant systems and mechanisms of supplementary investigation under the reform of supervision system.In the new context,the self supplementary investigation in the process of handling job-related crime cases belongs to the investigation power of the procuratorial organ,while returning the supplementary investigation is not a supplementary investigation in a broad sense.We should correctly distinguish the relationship between the two,unify the standard of proof and the rules of executing evidence judgment in the system design,and apply the outline of supplementary investigation,intervene and guide the self supplementary investigation in accordance with the law.
