| 摘 要： | 滥用职权罪的危害结果是对国家公务正当性的侵害,而＂致使公共财产、国家和人民利益遭受重大损失＂是犯罪客体遭受侵害后的＂进一步结果＂,将其解释为客观的超过要素是妥当的。国家机关工作人员收受贿赂,有滥用职权的行为,同时又构成受贿罪的,应当实行数罪并罚。
