我国《继承法》法定继承规定的民间态度——山东省民间继承习惯调查研究

我国现行继承法规定的法定继承人的范围基本上符合民间对继承人的选择,除法定继承人外,人们更注重是否是自己的直系血亲或者是否对自己给予了较多照顾。在继承顺序中,对于第一顺序继承人选择次序依次为配偶、子女和父母;选择兄弟姐妹作为第二顺序继承人的比例明显高于祖父母、外祖父母,而把祖父母、外祖父母不列入继承人范围的比例更高。对继承份额的分配的调查发现,大部分人持有公平观念,照顾弱者的传统也有存在。是否以夫妻名义同居在民间继承习惯上有很大区别。调查还表明,我国的继承法有必要规定遗产的归扣制度。

An Investigation and Study of Folk Custom of Statutory Succession in Shandong Province

The limits of heirs in statutory succession of China's Law of Succession accord with the civilian choice.They all pay much attention to whether a heir should be lineal descent and whether a heir give the deceased care.As the order of succession concerned,people would rather choose brother and sister as the second order heirs than choose their grandparent and grandparent in law as the second order heir.As the share of succession concerned,people hold the idea of fairness and pay much attention to the feebleness.There is great difference in succession between whether the heir and the deceased cohabitate in name of husband and wife.As a result,the author considers that there should be the provisions concerning heritage return system.
