欧盟港口领域禁止滥用市场支配地位的案例研究

在介绍欧盟禁止滥用市场支配地位基本制度的基础上,结合相关案例,对相关市场划分、支配地位认定规则、滥用行为的认定和典型形态、反竞争效果等构成因素在港口领域的适用进行分析,认为中国应当强调效果主义分析思路的运用;结合中国港口的特色,完善相关要素的认定;注重禁止滥用市场支配地位的一般制度在港口领域适用的一致性,同时又要充分体现港口领域竞争的特点.

Case study on abuse of dominant position in EU port field

Based on EU＇ s general system of Prohibition of Abuse of Dominant Position and a serious of port cases, this paper analyzes the application of related elements, especially the relevant market, dominant position, typical abuse action and anti- competitive foreclosure, in port sector. Upon them, the paper suggests that, China shall apply the effect-based approach on the regulation of port competition, and need to improve the identification of elements based on the trait of China ports. Fur- thermore, we shall keep the consistency of the general rules of anti-abuse of dominant position in port area on one hand and embrace specific characters of port competition of the application on the other hand.
