海上保险代位求偿诉讼时效起算之特例研究

保险代位求偿权的诉讼时效起算历来存在不同理论观点,司法实务中也不尽统一。最高人民法院《关于适用〈中华人民共和国保险法〉若干问题的解释（二）》对此问题虽作出了明确规定,但理论层面的争论依然存在,特别是该规定是否适用于海上保险,值得探讨。从保险代位求偿权的权利性质出发,对《关于适用〈中华人民共和国保险法〉若干问题的解释（二）》相关规定出台背景加以深入剖析,并结合海上保险的特点和海商法时效制度的特别规定,对海上保险代位求偿诉讼时效起算的法律适用提出建设性方案,以期在保险人与有责任第三人之间的利益保护方面取得平衡,并为有权机关进一步完善保险代位求偿时效的规定提供参考依据。

Special case study on the commencement of the time bar in the case of marine insurance subrogation

On the commencement of the time bar in marine insurance subrogation cases,there are always different opinions both in theory and practice. Although the Judicial Interpretation II of the Insurance Law by the Supreme People＇s Court has already made specific rules on this issue,the dispute in theory still remains. Whether the rules can be applied to marine insurance is a problem worth special discussion. In consideration of the nature of the marine insurance subrogation,the paper deeply analyses the legislative background of the Judicial Interpretation II of the Insurance Law by the Supreme People＇s Court,considers the features of marine insurance and the special rules on limitation of actions in maritime law,raises constructive solutions about the application of law on the commencement of time bar in marine insurance subrogation cases. By doing this,the paper intends to balance the interests between the insurer and the responsible third party,and to provide reference for competent authorities in refining the rules on the limitation of actions in insurance subrogation.
