| 摘 要： | 在刑事诉讼中，警察的主要任务是收集不利于被告人的证据，警察不出庭作证，不仅剥夺了被告人的质询权，而且影响法庭的正确裁判，容易造成冤假错案。为了维护程序正义，保证被告人的质询权，发现案件真实，警察应当出庭作证。

| Abstract: | During criminal procedure,what the police want to do is collecting the evidence of case which is not good to the accused. It is not only denied of inquired rights of the accused, but also is not good to judge ease, if the police is not in court. In order to protect procedure juice and the inquiring right of accused and find the true fact of case, the police should bein court. |
