壮族习惯法及其特征与功能

壮族习惯法是广西壮族民间强制性的准法规范。它作为一种巨大深厚的社会存量,被特定的社会群体所选择、收纳、共享,成为壮族共遵共循的行为准则。本文着重阐述了壮族在集体生活、社会治安管理、保护人身安全、婚姻家庭、财产继承等方面习惯法的主要内容。并对壮族习惯法的审理、处罚进行了论述。认为壮族习惯法突出呈现出植根的乡土性、内容的生活性、管辖的地域性、运作的强制性、法规的不成文性、程序的不完善性等特征。并在壮族社会生活中发挥着维系功能,理顺社会秩序,维护社会稳定;调整功能,排解纠纷,协调关系;制约功能,规范行为,惩诫恶行;传承功能,传递民族文化,宏扬民族精神;教育功能,寓理于法,培养社会角色。

On the Characters and Functions of Zhuang Nationaly in Guangxi

As a folk compulsory quasi-law and a massage social storage, the customary law of Zhuang Nationality has become the code of conduct of Zhuang Nationality after being chosen, absorbed and shared by the certain social groups. This article expounds the content of the customary law in collective life, public order administration, personal security protection, marriage and family life, property inheritance, as well as in the adjudication and punishment, then concludes the characters of the customary law of Zhuang Nationality-localization in the basic, living in the content, regionalization in the administration, compulsion in the application, un-written in the laws, imperfection in the system. The customary law of Zhuang Nationality has four functions: maintenance function, which straightens out the social order and maintains the stability of society; adjustment function, which resolves the dispute and harmonizes the relations; restrictive function, which standardizes people's behaviors and punishes the guilt; transmission function, which transmits the national culture and spirit; education function, which combines morality with law and fosters the social roles.
