| 摘 要： | 我国签署《公民权利和政治权利国际公约》后,在公民个人权利保护方面做了不懈的努力,但在赦免制度的构建方面还存在较大的纰漏。应从全球化的视野出发,通过考察各缔约国在赦免权行使模式方面的不同规定,结合我国实际情况,着力探讨我国赦免权的构建,实行一种二元化的行使模式,并提出实现这种行使模式的构想。

| Abstract: | Though our country has made effort to protect the citizen's personal human right after joining "international convention on civil right and political right", there are some problems in our legal systems, particularly in absolution system. This paper is concerning about analyzing some absolution systems of foreign countries with the actual situation of our country, and advances some proposals for the realization of duality of absolution right and its countermeasures. |
