人民警察执行职务中的不作为犯罪研究

警察执行职务中的不作为犯罪的危害是非常严重的。不作为是指行为人负有实施法律要求的某种行为的积极义务,并且能够实行而不实行的行为。不作为的成立必须具备三个条件:行为人负有某种特定义务,行为人能够履行而没有履行这种义务,造成刑法所保护的社会主义社会关系的损害。警察不作为成立犯罪同样要符合上述条件。
