| 摘 要： | 法的价值取向决定了法律制度发挥作用的方向。合同法作为法律制度尤其是私法制度中的重要组成部分 ,体现和维护了一定的价值目标。它确认和维护了交易秩序、合同自由与交易公平 ,以及交易效率。对合同法的上述价值目标的研讨 ,无疑能有助于我们更好地理解合同法的要义 ,更好地运用和实施合同法 ,使这部合同法在我国市场经济建设中发挥其应有的重要用用。
