刑事被害人权利保障浅析

我国刑事诉讼法虽然明确规定了刑事被害人的诉讼主体地位,并赋予了其一系列诉讼权利,但在权利保障上还有诸多缺失和不足。本文从加强被害人权利保障的必要性、紧迫性及权利保障的缺失现状出发,建议通过借鉴域外有益经验,结合国情与传统,完善被害人的诉讼参与权、获得法律帮助权、赋予其上诉权、健全防止其受第二次伤害的机制、保障其获得死亡赔偿金和精神抚慰金在内的损失赔偿权、及时获得国家救助和社会保障、加强恢复性司法和刑事和解救济等,以期落实以人为本科学发展观,减少社会问题,实现和谐稳定。

An Analysis of Protecting the Rights of Criminal Victims

Although China's Criminal Procedure Law clearly specifies the victims' position in criminal proceedings, and gives them a series of proceedings rights, there are still deficiencies and shortcomings in the rights safeguarding. In consideration of the necessity and urgency of protecting the rights of victims, this paper gives a piece of advice. Through the adoption of useful extra-territorial experience jointly with the national conditions and traditions, we can perfect the victims' rights to participate in the proceedings and to access to legal assistance, give them the rights of appeal, amplify the system of preventing the victims from the second injury, ensure them to get compensation for the damages involving death and spirit damages and the rights to timely access to national relief and social security, strengthen criminal justice and restore reconciliation relief, so we can implement the scientific concept of development and reduce social issue and achieve social harmony and stability.
