| 摘 要： | 工伤保险与侵权损害赔偿的适用关系应以补充模式为原则,以取代模式为例外。一般情况下劳动者遭受工伤事故既可以请求工伤保险赔偿,又可以请求侵权损害赔偿,但赔偿总额不得超过实际损失保险人对工伤事故有先为赔付的义务,在其赔付之后可以在赔付范围内向加害人追偿。在雇主对工伤事故没有过错时则应适用取代模式,劳动者只能请求工伤保险赔偿。
