| 摘 要： | 合同诈骗罪作为一种以合同为掩护、手段隐蔽、情况复杂的犯罪,在所有的诈骗犯罪中,占有相当高的比例,成为目前刑事司法实践中热点和难点.对合同诈骗罪中"非法占有目的"之认定、合同诈骗罪中担保刑事责任之厘清等疑难问题作深入探讨,有助于实践中准确对此罪的把握和认定.

| Abstract: | The crime on contract fraud is the crime that imposes contract as pose.The crime has traits of masking and complicated.Among all fraudulence crimes,the crime on contract fraud has higher proportion.Thus,the study about crime on contract fraud has become to the popular point and the difficult point in criminal judicial practice.In this article,we need to study some problems about recognizing "the illegal aim of possess" and the criminal burden of assure,which are beneficial to the criminal's correct holding and recognizing. |
