论无独立请求权第三人诉讼权利的程序保障

我国无独立请求权第三人制度的立法规定存在许多缺陷，主要表现是，无独立请求权第三人的诉讼地位不明确，参诉依据具有模糊性，参诉方式存在被动性。无独立请求权第三人制度存在诸多问题的根本原因是无独立请求权第三人的诉讼权利缺乏程序保障。保障无独立请求权第三人的诉讼权利并建立辅助参加制度应当是无独立请求权第三人制度改革的基本方向。
