摘    要:我国社会主义市场经济发展至今,虚假广告已泛滥成灾.然而,我国现行法对虚假广告的规范和界定过于简单,形式上虽然采取了综合调整的立法模式,但实质上并未形成统一的虚假广告法律评判体系.因此,为更好满足法律适用的需要,在现行法律规定的基础上,采用学理的方法进行分析和整合,同时借鉴美国法律对虚假广告认定的一般做法,从而对我国虚假广告的一般界定与构成作出相对完整的表述.

Abstract:During the process of developing the socialistic market economy system in our country, a variety of mendacious advertisements have turned into overrun. Nevertheless, our nation's current regulations actually are so simple on definition and the rules of mendacious advertisement that there is no uniform legal system to judge mendacious advertisement, despite adopting a comprehensive adjustment mode in legislation. Facing such kind of situation, to meet the demands of law application, it is essential to make a comparatively entire interpretation for the general definition and constitution requisites of mendacious advertisement on the basis of regulations of present laws. During the study, jurisprudence methods are applied to make an analysis and integration, meanwhile usual regulations in American acts on mendacious advertisement are used for reference.
