行政案件审理中准用民事诉讼规定之实践考察——兼谈《行政诉讼法》第101条的完善

行政案件审理中对民事诉讼相关规定的准用是我国《行政诉讼法》的一项重要规则,对民事诉讼相关规定的准用应当满足一定条件。司法实践表明,采取制度列举的形式将准用条款写入《行政诉讼法》是必要且正确的;但与此同时,该条款也存在找法成本较高、不能满足实践需求等局限。行政诉讼法中的准用条款应根据实践情况适时作出调整。现阶段,可通过司法解释对可准用的民事诉讼制度进行完全列举,并将《行政诉讼法》第101条中的“民事诉讼法”一词扩大解释为“《民事诉讼法》及其司法解释”,以及将多次适用、不宜直接适用和《民事诉讼法》及其相关司法解释以外但有准用价值的民事诉讼规定适时转化规定至《行政诉讼法》或其司法解释中。

Practical investigation on the approval of provisions of civil litigation in the trial of administrative cases--Also on the improvement of Article 101 of the Administrative Procedure Law

Approval of the relevant provisions of civil litigation in the trial of administrative cases is an important rule of China’s“Administrative Procedure Law”.Approval of the relevant provisions of civil litigation should meet certain conditions.Judicial practice shows that it is necessary and correct to adopt the approval clause in the Administrative Procedure Law in the form of system enumeration;but at the same time,the clause also has limitations such as high cost of finding law and inability to meet practical needs.The approval clause in the Administrative Procedure Law should be adjusted in time according to the actual situation.At this stage,the available civil litigation system can be fully enumerated through judicial interpretation,and the term“Civil Procedure Law”in Article 101 of the Administrative Procedure Law can be expanded to be interpreted as“the Civil Procedure Law and its judicial interpretation”,as well as the timely translation of the Civil Procedure Regulations that have been applied multiple times,are not suitable for direct application,and which are not applicable to the Civil Procedure Law and its related judicial interpretations but have approval value into the Administrative Procedure Law or its judicial interpretation.
