| 摘 要： | 在疫情防控背景下,法院对防疫医疗机构和企业解除财产保全措施可适用保全申请人撤回保全申请、被保全人提供担保以及法院认为应当解除保全的其他情形三类依据。但三类情形与疫情防控紧迫性及法律适用规范性间存在共同或各自的现实困难。事实上,法院以其他情形条款依职权解除保全最符合疫情防控的紧迫性,但面对其与财产保全制度的理论障碍,有必要以社会公共利益为限度,从立法、司法和协调机制三方面进行完善。
