我国集体土地所有权的检讨与重构

Self-Criticism and Reconstruction of Collective Ownership of Land in China

The long-period reform has formed the system of collective ownership of land in China, which has two defects: coexisting multilevel subjects and the fragment of rights. Therefore, it is important to reconstruct the traditional theory of right in rem system by emphasizing on the value of property use and setting up the dualist theory, that is, emphasizing on both the property ownership and property use. Under the guide of this theory, the reconstruction of state-ownership of land and farmer-possession and use of land is the ideal choice of perfecting the present system of collective ownership of land in China.
