| 摘 要： | 本文针对我国《海商法》现有规定 ,比较借鉴了外国立法 ,提出了我国《海商法》应分别规定提单持有人和收货人 ,以明确提单持有人的含义 ,并在此基础上 ,划分了提单持有人的权利、义务和责任。论文最后对我国《海商法》的修改提出了立法建议。

| Abstract: | In view of the present provisions of the Chinese Maritime Code and by comparing and using foreign legislation for reference, this paper proposes that Chinese Maritime Code should separately define holder and consignee so as to make clear the bill of lading holder's meaning. On the basis of which it provides Bill of Lading holder's right, obligations and liabilities. |
