物业管理之法律属性解析

物业管理在我国尚属新鲜事物,目前政府主管部门及相关的物业公司对物业管理多存在角色错位、行为不规范现象,其根本原因在于对物业管理的法律属性问题认识不清。从物业管理的两种形态入手,从民法的视角对物业管理的法律属性进行了解析。认为物业管理本质上属于私法行为,应由作为私法的民法来作基本的调整,政府公权力不应不适当地过多介入该领域,政府部门应转变对物业管理的方式;广大物业公司也应认识到手中的物业管理权本质上只是一种契约义务,应将自己摆在服务者位置。

The Characteristical Analysis of Estate Management

Estate management is a new thing in our country.The fundarmental reason of the confusing of the role in the government and the estate management company and the inappropriate action thus taken lie in the misunderstanding of the character of estate management.This article looks into the character of estate managemengt from the point of view of civil law by analysing two forms of management,which draws a conclusion that the estate management belongs to civil action and subject to civil law.The government shoud change the way of administration and should not interfere into this realm too much.Meanwhile the estate management company also should acknowledge that the management of estate is an obligation essentially from a contract and thus should become a serviceman instead.
