我国劳动基准的实施现状及对策

摘    要:劳动基准是指国家劳动基准法所规定的用人单位必须保障劳动者享有的最低劳动权利和劳动待遇,是劳动法中必须解决的核心问题。我国劳动基准实施的状况不尽人意已经成为社会各界关注的焦点之一,也成为劳动法学界近年来引起讨论最热烈、争论最激烈的重要问题。人们在探讨其中的缘由时很容易将其原因完全归结为政府职能缺位或公权力干预不力。作者认为我国市场经济体制下劳动关系调整应建立在有序的利益博弈机制基础上,只有以此为起点才能深入挖掘我国劳动基准实施面临困境的各种原因并找到摆脱困境所应实施的基本对策。

Abstract:Labor standard, which means the minimum rights and treatment of the laborer, is the core issue of labor law. The application of labor standard in China is not so agreeable and became a focus of the society and a issue of controversy in theoretical circle. Most attribute the reason of this to the malfunction of government or improper regulation of public power. The author takes the position that the adjustment of labor relationship should be on the basis of orderly game of interest. Only in this way, could it be possible to find the reasons for the problems in this area and the countermeasures to the problems.
