| 摘 要： | 刑法价值是主宰刑法的灵魂,但刑法价值体系的架构离不开刑法价值主体的有效支撑。刑事被害人在犯罪本质和犯罪行为结构中的重要地位和作用,决定了刑事被害人应当成为刑法价值主体格局中的重要一极,并在刑法价值中寻找到适宜的生存空间。

The important role of criminal victims in the essence and structure of a crime demands that criminal victims play an important role in the pattern of value subjects of criminal law, and find a suitalbe living space in the value of criminal law. |
