有关电子证据问题浅析

信息的飞跃发展使证据学研究乃至证据立法面临诸多考验。在证据信息化的大趋势下,以计算机及其网络为依托的电子数据在证明案件事实的过程中起着越来越重要的作用。本文在确认电子证据的概念及特性的基础上,揭示了电子证据必须经过立法确认的事实,并指出了电子证据在我国刑事司法实践中需要注意的几点问题,以引起立法注意。主张将电子证据可以并且必须作为新的证据类型列入法定的刑事证据清单中。

On the Study of Electronical Evidence

With the development of information, the study of evidence and legislation face more and more problems datas based on the computer and internet become more and more important in proving case facts. On the basis of electronic evidence's concept and characteristics, the author exposes the fact of legislation and some problems of the practice of electronical evidence, and advises that electronical evidence must be criminal evidence.
