两岸协议的规范建构

本文首先以强调物质与观念、利益与身份、能动者与结构相互作用的建构主义为基础，论述管制性规范与建构性规范的辩证关系。接着将这些概念应用到两岸关系分析。研究显示两岸协议主要还是各自利益考虑的管制性规范，其所产生的建构性规范也是如此思维下的各自主体身份认同。如果两岸能有共同合作、解决问题、获致利益的经验并持续深化，则两岸协议将有助于提升两岸认同，共创两岸美好未来。

Construction of Norms on the Cross-Strait Agreements

This paper firstly discusses the dialectical relationship between regulative norms and constitu- tive norms that base on constructivism which emphasizes the interaction between material and ideal, interest and identity, agent and structure. Then the article applies the concepts to analyze the cross-Strait relations. The research demonstrates that the main considerations between the cross-Strait agreements are still the regula tive norms according to self interests and which makes the constitutive norms on self subject identities in accordance with the same thought. If the cross-Strait sides have the experience about working together to solve problems and to gain benefits and which continue to deepen, the cross-Strait agreements will promote the cross-Strait identities to create the cross-Strait better future together.
