向食品生产商销售非食品原料行为的定性及证据认定问题

维护食品安全是刑法的重要职责,相关司法解释及指导性案例的出台有利于司法机关更好地适用涉食品安全罪名。结合典型案例研究分析,认为对犯罪分子生产、销售工业用牛羊油,并提供给相关食品企业的犯罪行为应当依据司法解释的规定以非法经营罪定罪处罚。

Problems Concerning the Categorization of the Behavior of Selling Non-food Material to Food Manufacturers and Evidence Identification

To protect the food safety is an important obligation of the criminal law and the related judicial and legal explanation and the promotion of precedents for guidance should be conducive to the conviction of such a crime. Based on typical cases and in accordance with the provisions of judicial and legal explanation, this paper attempts to categorize the criminal behavior of making and selling industry-used sheep and cattle oil to food manufacturing enterprises as illegal business crime and to give related penalty.
